Unsolicited E-mail Policy
Unsolicited e-mail or "spam" originating from a Server account or associated with a Server account is not tolerated. This includes any e-mail that promotes web sites hosted on a Server account but is sent from an e-mail address not associated with that Server account.
Unsolicited Electronic Mail. You are expressly prohibited from sending unsolicited bulk mail messages ("junk mail" or "spam"). This includes, but is not limited to, bulk mailing of commercial advertising, information announcements and political tracts. Such material may only be sent to those who have specifically requested it. Malicious or threatening email is also prohibited. Although we will make reasonable efforts to alert you to such activities and allow you an opportunity to cure them within a 12-hour period after discovery, we reserve the right to immediately deactivate your use of our service if we discover such activity. Further, you agree to indemnify and hold us harmless from any claim resulting from your use or distribution of electronic mail services through the service provided through this Agreement.
After the first violation of this policy, we will give you a warning. Administrators are responsible to forward any warnings we give concerning unsolicited e-mail to their organizations or business owners that send unsolicited e-mail. After the second violation, the account will be disabled without warning and the account may be terminated. Refunds will be prorated. Fees will be assessed for early termination of yearly contract obligation.
Customer Representative should make this policy clear to their organization or business owner before they order a Server account. We believe strongly in promoting "netiquette" or proper use of the Internet. A strong anti-spamming policy will benefit all of us.
Activities Subject to Immediate Deactivation
Any Server account that is used for illegal, abusive or unethical activity may be immediately deactivated by us without warning to you. Illegal, abusive or unethical activities may include, but are not limited to, pornography,obscenity, nudity, violations of privacy, hacking,computer virus, gambling, or promotion of gambling, and any harassing or harmful materials or uses as determined by us. You agree to indemnify and hold us harmless from any claim resulting from your publications or use of illegal, abusive or unethical materials. Although we will make reasonable effort to alert you to such activities and allow you an opportunity to cure them within a 24-hour period after discovery, we are not required to give such notice before deactivating your use of our services if, in our discretion, your use is or results in illegal, abusive, or unethical activities. If a Server account is disabled, the regular monthly fees still apply until the Customer terminates the Server account. Customer will be charged with setup fees and any additional fees incurred to set up said server after discontinuance.
Customer must keep in mind, if a host client is deactivated for any illegal, abusive or unethical activity, all domain names pointing to that hosted site and listed on that host account will be affected by the deactivation.
Notice of Confidentiality
CWD ENTERPRISES - CREATIVE WEB DESIGNS acknowledges that all information and documents disclosed by you, herein referred to as "The Customer", to CWD ENTERPRISES - CREATIVE WEB DESIGNS, or which come to the attention of CWD ENTERPRISES - CREATIVE WEB DESIGNS during the course of its service under this Agreement, constitutes valuable assets of and are proprietary to "The Customer".
CWD ENTERPRISES - CREATIVE WEB DESIGNS also acknowledges that "The Customer" has a responsibility to keep the "The Customer" records and information confidential and proprietary.
CWD ENTERPRISES - CREATIVE WEB DESIGNS agrees not to disclose, either directly or indirectly, to any person, firm or corporation, information of any kind, nature or description concerning matters affecting or relating to the business of "The Customer" without the written approval or consent from "The Customer", unless the information is already in the public domain.
CWD ENTERPRISES - CREATIVE WEB DESIGNS also agrees not to sell or exchange email addresses or same information for the purpose of advertising or solicitation unless "The Customer" agrees as listed in current or future forms, emails or in writing.
CWD ENTERPRISES - CREATIVE WEB DESIGNS uses only secure and confidential means of charging your credit card.
